Terms of Service

These terms govern your use of TCGBerg. In short: the data is informational market intelligence, provided as is, and is not financial advice. Please read the full terms below.
1. Acceptance of these terms
By accessing or using TCGBerg (the "Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service. We may update these terms from time to time; the "Last updated" date above reflects the current version, and continued use after a change means you accept it.
2. What TCGBerg is
TCGBerg is an informational market-intelligence service for the trading-card market. The fair values, market caps, indices, and deal signals we publish are modelled estimates derived from publicly recorded sales and dealer reporting. TCGBerg is not a marketplace, broker, dealer, auctioneer, or appraiser, and we are not a party to any transaction you enter into elsewhere.
3. Not financial or investment advice
Nothing on TCGBerg is financial, investment, tax, or trading advice, a recommendation, or an offer or solicitation to buy or sell anything. Our estimates are provided for general information only. You are solely responsible for your own buying, selling, and collecting decisions, and you should do your own research and consult a qualified professional where appropriate.
4. No warranty
The Service and all data on it are provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the data is accurate, complete, current, or uninterrupted. Prices and estimates may be delayed, incomplete, or wrong, and card markets are volatile. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
5. Acceptable use
You agree not to:
- scrape, harvest, or bulk-extract data from the Service, whether by automated means or by hand, beyond the attributed citation allowed in section 8, or use it to build or train a competing dataset, model, or product;
- circumvent, disable, or interfere with rate limits, security, or access controls;
- reverse engineer, decompile, or attempt to extract our source code or the non-public systems that run the Service;
- use the Service unlawfully, or in any way that disrupts it or burdens our infrastructure.
Our methodology is not one of those secrets. We publish how every metric is built, in full, in our methodology, including downloadable papers. Reading it, quoting it, and checking our numbers against it is what we published it for, and nothing above restricts that.
Search and AI crawlers are welcome on our public pages, within the limits published at /robots.txt and /llms.txt. That is permission to crawl and to cite us, not permission to copy the Service or to train on it. Section 8 sets out what you may do with the numbers you find.
6. Accounts and eligibility
You must be at least 16 years old to create an account. By creating an account, you represent that you meet this requirement. If we learn that an account was created by someone under the required age, we may delete the account.
Accounts are optional and purely additive: the full market data is available without signing in. An account adds personal features, your watchlist, your portfolio, price alerts, and access to our Pro-preview tools (such as the sell-price optimizer), which are currently free while in preview. If you create one, you are responsible for keeping your credentials secure and for the information you choose to enter. We may suspend or terminate accounts that abuse the Service or breach these terms.
7. Intellectual property
The TCGBerg name, branding, page design, and the selection, arrangement, and presentation of our analytics are owned by us or our licensors and are protected by law. Third-party names, card images, and grading data belong to their respective owners and are used for identification and commentary; see our Disclaimer and IP Notice. You may view and share our pages for personal, non-commercial use, but you may not copy, redistribute, or commercially exploit our data in bulk without permission.
8. Use of our data and analytics
The fair values, market caps, indices, confidence scores, deal signals, sell-price estimates, price forecasts, rankings, and other analytics published on TCGBerg are our own original work product. They are modelled estimates we create by applying our proprietary methodology to underlying market data: they are not raw facts and they are not in the public domain. The figures themselves, together with their selection, arrangement, and presentation, are owned by us and protected to the fullest extent of applicable law.
We welcome attributed citation. You may reference or quote a limited number of individual figures (for example, a TCGBerg fair value for a card, or an index level) in articles, posts, videos, research, and AI-generated answers, provided that you (a) clearly credit TCGBerg as the source, (b) link to the specific TCGBerg page the figure comes from wherever the medium allows, and (c) do not present the figure as your own or imply that TCGBerg endorses you. Reasonable, attributed use that points people back to TCGBerg is encouraged.
Outside that attributed reference use, you may not, without our prior written permission: copy, scrape, or bulk-extract our analytics; store, cache, redistribute, resell, or sublicense them; incorporate them into another product, dataset, price guide, index, or service; use them to train, fine-tune, or evaluate any machine-learning model; or use them to build or operate anything that competes with TCGBerg. These restrictions apply whether the use is automated or manual, and whether or not it is commercial.
We reserve all rights not expressly granted here. If you want to use our data beyond attributed citation (for example a data feed, an API license, or a commercial integration), contact us: we may be able to license it.
9. Affiliate links, creator codes, and third-party services
Some outbound links (for example to eBay) are affiliate links, and we may earn a commission when you buy through them at no extra cost to you. Third-party marketplaces, sites, and services are governed by their own terms and privacy policies. We do not control them and are not responsible for their content, listings, prices, or the transactions you make there.
We also run a creator referral programme. If you arrive through a creator link or type in a creator code, we credit that creator for your sign-up and may pay them a commission. It costs you nothing, it changes nothing about your account, and you get the same product at the same price either way. The rules are short: the first code attached to an account wins and is never rewritten; a code only counts for an account that is less than a week old; and we hold a code in your browser for 30 days, so a code you picked up before signing up still counts afterwards. We may change or end the programme at any time, which does not affect an account that has already been credited.
10. Limitation of liability
To the maximum extent permitted by law, TCGBerg and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of (or inability to use) the Service or your reliance on any data or estimate, including any purchase, sale, or collecting decision. Nothing in these terms excludes or limits our liability where it would be unlawful to do so, including for fraud, for death or personal injury caused by our negligence, for gross negligence or wilful misconduct, or for any rights you have as a consumer that cannot be waived. Subject to that, and to the extent any liability cannot otherwise be excluded, our total aggregate liability is limited to the greater of CHF 100 or the amount you paid to TCGBerg in the 12 months before the claim.
11. Indemnification
You agree to indemnify and hold harmless TCGBerg and its operators from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Service or your breach of these terms.
12. Changes to the Service
We are actively building TCGBerg and may add, change, or remove features at any time, including which tools sit inside Pro.
The founding offer is a promise we keep. If you join the founding list while it is open, the founding rate quoted on our plans page is the rate you pay if and when you choose to subscribe, and we will not raise it on you for as long as your subscription runs without a break. What we can still do is close the founding list, set or change the public Pro price for people who are not on it, and decide when Pro starts costing money.
We may also run other promotional offers from time to time, such as launch pricing, seasonal discounts, creator codes, bundled plans, or free trials. Each one has its own terms and its own window, offers cannot be combined unless we say so, and we may change or withdraw an offer at any time before you take it up. An offer we run later does not change a rate you were already promised, and equally, holding a founding rate does not entitle you to a later promotion.
Pro will have its own additional terms at launch covering billing, renewal, and cancellation, and those terms will not undo the rate you were promised.
We may also modify these terms; material changes will be reflected in the "Last updated" date above.
13. Governing law
These terms are governed by the laws of Switzerland, without regard to its conflict-of-laws rules. If you use the Service as a business or professional user, you agree to the exclusive jurisdiction of the competent courts of Switzerland for any dispute that is not otherwise resolved. If you use it as a consumer, this does not deprive you of the protection of the mandatory consumer-protection rules, or the right to bring proceedings in the courts, of the country where you live.
14. Intellectual property complaints
If you are a rights-holder and believe that content on TCGBerg infringes your copyright, trademark, or other rights, you can send us a notice at legal@tcgberg.com or through our contact page. Please describe the content, where it appears on the Service, the right you hold and why you believe it is infringed, and how we can reach you. We review substantiated notices and may remove, disable, or adjust the content in question. We do not currently host user-generated content, so we do not operate a designated DMCA agent; if that changes, we will appoint one and publish its details.
